Public officials and employees shall at all times be accountable to the people and shall discharge their duties with utmost responsibility, integrity, competence, and loyalty, act with patriotism and justice, lead modest lives, and uphold public interest over personal interest. RULE I NORMS OF BEHAVIOR Section 1. Norms of Conduct/Behavior of NBI Officials and Employees. 1. NBI officials and employees shall always uphold public interest over and above personal interest. All government resources and powers of their respective offices must be employed and used efficiently, effectively, honestly and economically, particularly to avoid wastage in public funds and revenues. 2. NBI officials and employees shall perform and discharge their duties with the highest degree of excellence, professionalism, intelligence and skill. They shall enter public service with utmost devotion and dedication to duty. They shall endeavor to discourage wrong perceptions of their roles as dispensers or peddlers of undue patronage. 3. NBI officials and employees shall remain true to the people at all times. They must act with justness and sincerity and shall not discriminate against anyone, especially the poor and the underprivileged. They shall, at all times, respect the rights of others and shall refrain from doing acts contrary to law, good morals, good customs, public policy, public order, public safety and public interest. They shall not dispense or extend undue favors on account of their office to their relatives, whether by consanguinity or affinity, except with respect to appointments of such relatives to positions considered strictly confidential or as members of their personal staff whose terms are coterminous with theirs. 4. NBI officials and employees shall provide service to everyone without discrimination and regardless of party or religious affiliation or preference. 5. NBI officials and employees shall extend prompt, courteous, and adequate service to the public. Unless otherwise provided by law or when required by the public interest, NBI officials and employees shall provide information of their policies and procedures in clear and understandable language, conduct public consultations and hearings whenever appropriate, encourage suggestions, simplify and systematize policies, rules and procedures, avoid red tape and develop an understanding and appreciation of the socio-economic conditions prevailing in the country, especially in the depressed rural and urban areas. 6. NBI officials and employees shall, at all times, be loyal to the Republic and to the Filipino people, promote the use of locally produced goods, resources and technology and encourage appreciation and pride of country and people. They shall endeavor to maintain and defend Philippine sovereignty against foreign intrusion. 7. NBI officials and employees shall, at all times, uphold the Constitution and commit themselves to the democratic way of life and values and maintain the principle of public trust and accountability. 8. NBI officials and employees and their families shall lead modest lives appropriate to their positions and income. They shall not indulge in extravagant or ostentatious display of wealth in any form. In addition to Section 1, NBI Agents/Special Investigators are also duty-bound to: 1. Safeguard lives and property; and protect the innocent against deception, the weak against oppression or intimidation, and the peaceful against violence or disorder. 2. Respect the Constitutional rights of all persons to liberty, equality and justice. 3. Keep their private lives unsullied as an example to all. 4. Maintain courageous calm in the face of danger, scorn or ridicule. 5. Develop self-restraint. 6. Be constantly mindful of the welfare of others. 7. Be honest in thought and in deed, in both their personal and official lives. 8. Keep secret what they hear or see of a confidential nature or that is confided to them in their official capacities, unless revelation is necessary in the performance of their duty. 9. Keep personal feelings, prejudices, animosities or friendships from influencing their decisions. 10. Enforce the law courteously and appropriately without fear or favor, malice or ill will, without employing unnecessary force or violence, and without accepting gratuities. 11. Be exemplary by obeying the laws of the land. 12. Never use unnecessary force or violence. 13. What is Segmentation Targeting and Positioning As we studied the definition of marketing as understanding customer needs and working to satisfy their needs, but different customers have different tastes, needs, and wants. That means they do not want same products and services, hence the need of dividing the market comes into the picture.Finding potential market which has potential customer and satisfies organisational goal i.e. profit is done in dividing market or in other words Market Segmentation. Products or services offered by organisation should be landed off at right place. Segmentation emerges as a need for marketing managers when it is needed to make their product at right place. There are three broader groups in which market can be segmented: Behavioural, Psychographic, Profile. These included variables are applied for different products of parent companies before segmenting the market. Psychographic variables: This variable suggests grouping customers on their lifestyle and personality. These include lifestyle and personality. This includes age, gender, lifecycle, social class, income, geographic, and geo-demographic.The main reason being the modes of reaching customer are defined in this variable i.e. readership or viewership in different location, different age/gender, different income groups etc. Tyre industry segmentation process is simple and narrow because of less variety of parent products. Michelin had segmented its products on basis of utilization based on automotive industry. Their products and services have been widely segmented according to use and demographic. Their main emphasis is on demographic locations which clearly define that requirements are different for different areas. Michelin has divided its products and services globally as core product, value added services, innovation drive and engineering services. Core products include tires for different segments of use and requirement. Market segmentation of Michelin has done is as shown below: Targeting is mainly done using three broad strategies: Mass Marketing is way in which instead of analysing the differences of customers want we analyse similarities whichever may be the market segment. Since the ballpark is so huge, by the time the smoke reaches the parks perimeter, it will be severely diluted by the size of the park and the distance from the fire to the spectators. Although the spectators might know about its benefits, the area is so spread out that theyll hardly smell the smoke. The end result will be minimal unless a tremendous amount of currency is set on fire to produce much more smoke. On the other hand, I see a niche marketing person as someone who takes the same pile of dollar bills, goes over to a pre-determined section of the bleachers then sets his pile on fire. Directors Duties Problem Question The establishment of Shine Ltd was with the sole intent to produce industrial solvents and cleaning solutions. Appointment of the office of managing director was given to John to cover that post. During this course, the company acquired an agreement with XYZ plc a conglomerate. While still under the directorship of John the company came up with a new super glue. In his capacity as a director, he presented this to the manager with the hope that it would be supported, and the production would continue since he felt it would be a lucrative business. The board of trustees were however of a different opinion, and they ended up rejecting the project. The managing director of XYZ plc is a friend of John, and so he disclosed their intentions not to renew their contract with Shine Ltd. Their reason was that the partnership had not born as much success as they had hoped. He would, however, continue his dealings with John if only he were not attached to Shine Ltd. With this in mind, he resigned and instead formed his company, Flush Ltd. A company that later partnered with XYZ plc. The company also took up the project of manufacturing the glue Shine Ltd board of directors had rejected, and it has proved very profitable. The corporate opportunity dictates that the director is not allowed to take for themselves any business opportunity that otherwise would have been beneficial to the corporation. It falls within the fiduciary duty of loyalty applications. The conditions in the act are clearly stipulated. It becomes limited to the Director, officers, and controlling shareholders (Esser, 2007). The act specifies that it is applicable whether the transaction harms the corporation. That is to say should the director go against this rule in the process make the cooperation benefit it does not mean he gets exempted from having broken particular law. The other part of this rule is that the corporation should not have obtained information regarding the opportunity that was presented. In the case where the board is aware and declines to take the opportunity then the fiduciary would take the opportunity for himself. Should the rule apply however the corporation becomes entitled to the profit earning for the fid uciary from the transaction? Having considered all the activities that took place in case study this particular rule might not apply to John. While being the director of Shine Ltd, he took the idea to the board of trustees and following the rules stipulated in the Company act that would have been his responsibility. In this case, both John and the board of directors were aware of opportunity yet the board choose to ignore. With this in mind, it then becomes apparent that the opportunity would now belong to John. However, that does not mean that he gets to walk (Lowry, 2009). Section 170 deals with the responsibility of the director of an organization. In as much as they are given the top most job, this section dictates what is expected of them from the daily operation of the group. Section 174 deals with the responsibility of the director to exercise care, skill and diligence. Their knowledge needs to be such that they are helpful to the organization. The manager has to handle the activities of the organization about his or her skills in that position. A factor also emphasized in Section 175. The part worth highlighting would be the second rule that specifies that it would be in conflict of interest to exploit information or opportunity gotten as a result of the position they hold in the company. Section 176 talks about Duty not to accept benefits from third parties. Of note is the second part where the aspect of the third party gets explained into details. Anyone who falls within the organization as a partner of an associate falls within this section. S ection 177 deals with the responsibility of the organizations director who might find himself in a conflict of interest. He has to offer the board with a declaration letter to announce the presence of a conflict of interest before they get to discover on their own. Section 178 deals with the consequences of a breach of duty. It highlights that the section 171 to 177 having the same kind of punishment should the director have breached that contract. However, section 174 makes the management have an open idea concerning what can pass as a breach of contract since it is a section open to interpretation. Section 180 deals with the parts that can be considered to be in a position to assume. Having examined the effects and the position that they take make them be applicable or be ignored depending on the location. Examining the case studies the duties mentioned above of the director were never fulfilled by John in his capacity as director of the organization. He stands liable for all accounts of the negligence of functions of the Director. The company is on the right to take legal action concerning the negligence of duties as director. The seems to be a violation of the equitable principle. Before ruling out that the case is worth being given a civil claim the three rules need to get approved to have existed. The information that is being shared should contain a certain degree of confidence. That is to say, it gets classified as being confidential. The provision of the information falls into the category of imposing on the application of obligation confidence. The information received was unautho rized when being used (Payne, 2008). Considering the case study provided it is clear that the above conditions were all fulfilled. Working as the director of Shine Ltd the information that he shared with his friend would best fit this category. The information should not have been disclosed to anyone since the company owned it. While the information was being given he was working as the director of Shine. While there seems to be no documentation on the issue of permission to use this product for profit. Lack of proper authority to present the solution in this case ruling out the possibility that the process was ever legal (Payne, 2008). Section 178 talks about the enforcement of the laws that govern the directors duties. In cases where the company has incurred losses due to the actions of the director then he becomes liable as a person. The director is to be made to restore the property of the company should he have lead to the destruction of any other property under his care. The director will have to account for any of the other profits they might have made while using the secrets acquired from the organization. It, therefore, becomes necessary for the board of directors to take into account section 178(2) when dealing with John (Sheikh, 2013). The director should defend himself on the grounds that he had presented the idea to the board and he had been told it would not be approved. In as far as production of the product it was well in his duty in accordance with section 174, and 175 to take up the deal for himself. When coming up with the verdict for the case study it will be prudent to consider the case of Cooley. In his capacity in the company, he exploited the information he got from the company for personal gain. His conditions, as presented, make a clear example of the exact position that John is in with his company. Following the verdict passed in the case of IDC v Cooley (1972), John should be found guilty of misuse of office and as such ought to pay the profits from the contract. It becomes irrelevant that his actions were not causing the company to lose the deal. The rule of conflict of interest stems from the fact the one might have exploited an opportunity that was rightfully in breach of his position. The opportunity might have gotten it in a way that is legal. The position John held concerning the company gave him the upper hand in the acquisition of the project. He is liable for damages regarding the section of the act that touches on conflict of interest. Following the verdict of Regal (Hastings) v Gulliver, (1942) John should be held liable for his choices. He should pay the company for the damages he inflicted using his profits he accumulated in the project that he got from the deal. The formation of Flush Ltd was for the sole purpose of making sure that the start of the contract with XYZ plc. John created a legal person as a shield against the legal actions with his former company. The action he took the lead to the company losing some of its clients and its long-time partner. All this he did knowing full well that his responsibilities to Shine Ltd would not allow him do what he was doing. The board of shine Ltd should also look into pursuing a lawsuit against Flush Ltd. The reason being that they have violated their position and in the process acquired some of its clients in the process. The Significance of Mother-Daughter Relationships in Amy Tanââ¬â¢s The Joy Luck Club In her novel The Joy Luck Club, Amy Tan tells of the lives of four Chinese immigrant mothers, their hopes, their dreams and the way each of their daughters feel about their mother's lives.à Mother-daughter relationships are the basis for the entire story.à Tan shows the hardships each mother experiences as a child and young adult, and how they all want better lives for their daughters.à She shows the struggles between the mothers and the daughters;à these struggles result from many different things, from the cultural gap, to dreams and goals that may have been set too high.à Each daughter knows her mother means well, but this does not make the battles any easier.à Through careful details Amy Tan shows readers the significance of each of the four mother-daughter relationships in the novel, how each daughter is slowly but surely becoming her mother. Even though Suyuan Woo is not alive her story is told through her daughter, Jing-mei ââ¬Å"Juneâ⬠Woo.à In the beginning of the novel readers witness June realizing how little she really knows about her mother and her heritage when she joins the other members of the club her mother founded called Joy Luck.à Jing-mei struggles with the division between who she is and who her mother wants her to be.à ""Only two kinds of daughters."à She shouted in Chinese.à "Those who are obedient and those who follow their own mind!"à Only one kind of daughter can live in this house.à Obedient daughter."" (153) Suyuan yells this when Jing-mei refuses to practice the piano after her embarrassing performance in the talent show.à She wants her mother to realize that she doesn't have to be a genius to be special, but Suyuan do... ...y knew that in the U.S. children would be able to choose whom they married and which career they wanted to pursue. Each mother had wanted to tell her children the events she had endured but did not feel the children would appreciate the stories for their full value.à à For many years, the mothers did not tell their daughters their stories until they were sure that their wayward offspring would listen, and by then, it is almost too late to make them understand their heritage that their mothers left behind, long ago, when they left China.à The mothers knew their children must be old enough to understand what the meaning of their travels to the United States meant to them.à They came to this country with many hopes and dreams, not only for themselves but for the children they would soon raise. Joining Wrestling Team Essay
There are many sports that a student can join in high school, but there is one sport that separates itself from the rest. The sport, without a doubt, is wresting. Wrestling is an outstanding sport because it teaches discipline, tenacity, and the values of friendship. The only way to succeed in this sport is with discipline. Wrestling far exceeds the practice times and schedules of football, which is thought to be the ââ¬Å"toughestâ⬠sport. Wrestlers must stay in shape, have a very low body fat percentage, and must be lean and muscular. A wrestling practice can start with a six mile jog followed by a thirty minute session of running up stairs, and carrying people on their backs. Afterwards, the wrestler would engage in a full practice of drills, learning new moves, and going ââ¬Å"Liveâ⬠. Live is not quite drilling, but not as intense as a real match. It allows wrestlers to see what will happen when they try new moves and counters in a sort of ââ¬Å"practiceâ⬠match. Not many people are physically and mentally fit for this kind of practice. Only a select few can cope with it without giving up. There are many other aspects of the sport that not many of the participants can overcome. One of these would be that when anyone hears the word ââ¬Å"wrestlingâ⬠, they would think of a gay sport. These people could not be more wrong. Many of the moves require grabbing the inner thigh or lying on top of the opponent, but this does not mean the sport is gay. This sport measures a manââ¬â¢s brute strength and skill in the most primitive of ways. Matches are paired up with wrestlers equal in weight so that no one has an advantage in weight. This sport dates back 15,000 B.C. to early Egyptian and Babylonian beliefs and cave drawing found in France. Tenacity is also a key factor of becoming a wrestler. This sport requires a wrestler to have a highly developed stamina, because a match can tire a person out in under a minute if he or she is not in shape. During a match, a wrestler must fight with all he has to not let his opponent hold them down on their shoulder blades for three seconds, and this is no easy task. Even though a match is almost always less than six minutes, most wrestlers are gasping for air as they wobble back to their seat whether they won or lost.à Their senses go haywire, and the room keeps spinning and then everything comes back to them a few minutes afterward. Tenacity would also play in a role with the fact that sometimes wrestlers have to ââ¬Å"cutâ⬠weight so their body weighs a predetermined weight before a given match. This is for the few people that naturally weigh in-between classes. Rumor has it that the lighter a person gets, the easier it is, but this is not true, and is dangerous to oneââ¬â¢s health. Even though the first few weeks of practice would burn off at least three pounds off of everyone because of the intense training, a few ignorant people would put on plastic suits and sweat off as much as fifteen pounds! These are the hard-core wrestlers who think that being lighter is so important that they feel that have to drop down to a very unsafe weight class. The more they sweat, the more dehydrated they get, and from this, a wrestlerââ¬â¢s metabolism would slow down, making it nearly impossible for them to lose any more weight. This is their body protecting itself from the wrestlerââ¬â¢s unsafe conditions it puts itself through. If he does not stop what he is doing, the body would completely shutdown, and the wrestler would be tired within minutes, as well as pull muscles, jam fingers, and get strains much more frequently. This ultimately leads to a really good wrestler losing to a beginner who cannot even compare in skill or experience because he was too tired to go on. This sport is not the easiest to accept, but the lessons a wrester learns are well worth it. Wrestling is an individual sport ââ¬â in the sense that the outcome of a match is solely dependent on how that person did ââ¬â but teamwork is required in every aspect other than the actual match. A wrestlerââ¬â¢s training partner is the one person who can warn them when a move they did was done incorrectly or if there is a way to make the move more efficient. Only with a good training partner can a wrestler find and work on positions and moves that are troublesome. As the season progresses, the wrestlers on the team would get to know each other much more then any of their friends would. Wrestlers grow together inà suffering from the intense practices and the significant amount of time they spend with each other during the season. Wrestlers of the same team usually hang out together and would go out for pizza as a team after a match they won to celebrate. The bond a wrestling team gets as the season ends is much different from a friendship, for it has no boundaries in trust, kindness, and loyalty. This sport has a bad reputation for many things that are untrue. Wrestling is not gay, and it does not make anyone ââ¬Å"cutâ⬠weight in order to participate. This is a sport unlike any other, for the fact that a person must have a few key qualities to excel in the sport. Any person, athletic or not, has no reason not to sign up for the team.

Educated Consumers * Educated Consumers Now a potential buyer isnââ¬â¢t at the mercy of a salesperson. Many big name retailers give bonuses to their sales people for selling certain items each month. A customer may not necessarily get the product that fits his or her needs. Now, if someone is looking for a computer, new car or kitchen appliance, there are many websites that offer free customer service and expert reviews on products. Virtual Retailers * Virtual Business There are many business that now operate solely from the Internet. Take Amazon, for example. A consumer can type into the Amazon search engine just about anything he wants, and within seconds it is right at his fingertips. Further, when he buys the item and has it shipped to him, he can track it every step of the way. If something is being shipped FedEx, a tracking number is all a customer needs to find out what city his package is in, whether itââ¬â¢s in the truck or at the hub, and what time it will arrive at his door. Endless Possibilities * The Sky is the Limit Overall, the Internet has had a positive effect on business. It has opened up doors for people and businesses across the globe and has made people worldwide understand that now the skyââ¬â¢s the limit.
